Who we are and who these Terms apply to
These Terms of Use govern access to and use of Capitown, including the site (capitown.com) and the app (app.capitown.com). By creating an account, accepting an invite, or using the service, you agree to them. They should be read together with the Privacy Policy.
Capitown is operated by LUIZ PAULO PILEGI DE ALMEIDA LTDA, enrolled with the CNPJ under No. 47.692.790/0001-87, with its principal office in Curitiba/PR, Brazil.
To make this easier to read, we use the same terms as the Privacy Policy:
- Space: the virtual office (the live map) created by a team or company.
- Administrator: the person who creates the Space, subscribes to a plan, and invites everyone else.
- Member: the person invited to join the Space.
- User: anyone who uses Capitown, whether an Administrator or a Member.
What Capitown is
Capitown is a software service (SaaS) that offers virtual Spaces with a real-time map, avatars, presence, and voice calls between Members. You walk up to someone else’s desk to talk, as in a real office.
Capitown is a work tool, intended for people 18 and older. It is not a social network, it does not record meetings, and it does not replace your company’s internal rules.
Account, Space, and responsibilities
To use Capitown, you need an account with information that is true, complete, and up to date. You are responsible for keeping your password safe, for all activity on your account, and for telling us if you suspect unauthorized access.
Each role has its own responsibilities:
Administrator
What they decide or doCreates the Space, subscribes to the plan, invites and removes Members, and sets each person’s role.
ResponsibilitiesHave authority to contract for the team or company; set internal rules of use; tell Members how data is processed in the Space.
Member
What they decide or doJoins the Space by invite, customizes the avatar, and takes part in calls.
ResponsibilitiesFollow these Terms and the Administrator’s rules; respect the other Members.
| Role | What they decide or do | Responsibilities |
|---|---|---|
| Administrator | Creates the Space, subscribes to the plan, invites and removes Members, and sets each person’s role. | Have authority to contract for the team or company; set internal rules of use; tell Members how data is processed in the Space. |
| Member | Joins the Space by invite, customizes the avatar, and takes part in calls. | Follow these Terms and the Administrator’s rules; respect the other Members. |
If you are a Member, your company may have its own rules about using Capitown at work. For questions about those rules, talk to your Space Administrator first.
Plans, payment, and cancellation
The plans, prices, and features in effect are shown on the site and in the app at the time of subscription. Billing is the Administrator’s responsibility and is processed by Stripe. Capitown does not store the full card number.
Cancellation can be requested at any time and takes effect at the end of the period already paid, without limiting rights provided by law, such as the right of withdrawal under article 49 of the Brazilian Consumer Protection Code, where it applies. Price changes will be announced with reasonable notice and do not affect the period already paid.
Failure to pay may lead to suspension or closure of the Space, with reasonable prior notice. After cancellation, data is deleted or anonymized within the time limits in the Privacy Policy.
Voice calls and presence on the map
Other Members of the same Space see your short name, avatar color, position on the map, and whether you are in a call. Audio is transmitted encrypted in transit and only reaches someone who is signed in and close enough to the desk. Capitown does not record or store call audio.
Anyone who records, transcribes, or writes down a conversation on their own, outside Capitown, is solely responsible for getting the other participants’ consent and for complying with applicable law, especially the LGPD. Agree on the rules of use with your team.
Your data
Personal data is processed under Law No. 13,709/2018 (LGPD) and the Privacy Policy, which is part of these Terms. For Member data inside a Space, Capitown acts as processor, following the Administrator’s instructions. The Administrator acts as controller of that data.
We do not sell personal data and we do not use conversation content to train models or to advertise. What we collect, how long we keep it, and how to ask for access, correction, or deletion is in the Privacy Policy.
What is not allowed
The User must not:
- use the service for unlawful purposes or to harm the honor, image, or privacy of others, including harassment, discrimination, and threats;
- try to access Spaces, accounts, or data of others without authorization;
- bypass authentication, usage limits, or security controls, or overload the infrastructure;
- reverse engineer, copy, resell, sublicense, or redistribute the service without authorization;
- transmit viruses or content that violates the rights of others;
- share the account or invites in a way that goes against these Terms.
A breach allows us to suspend or block access, without limiting any legal measures that may apply.
Intellectual property
The Capitown brand, the software, the layout, the visual elements, the text, and the documentation belong to LUIZ PAULO PILEGI DE ALMEIDA LTDA and are protected by intellectual property law.
Use of the service grants the User a personal, limited, revocable, non-exclusive, and non-transferable license to access and use it while the account is active. Data and content the User adds remain theirs, and Capitown receives only the license needed to operate the service.
Availability and limits of liability
The service is provided as available and may be interrupted for maintenance, because of failures by third-party providers (such as hosting, audio infrastructure, and payments), or because of unforeseeable circumstances or force majeure. Capitown may change, suspend, or discontinue features, with reasonable prior notice when the impact is significant.
To the fullest extent permitted by law, and without limiting rights that cannot be waived (including those under the Brazilian Consumer Protection Code, where it applies), Capitown’s liability is limited to proven direct damages, does not cover lost profits, loss of opportunity, or indirect damages, and is capped at the amount the Administrator paid in the 12 months before the event.
Termination
You can close your account at any time. Capitown may suspend or end access if these Terms are breached, if payment is overdue, if there is a risk to the security of the service, or if the law requires it, and will give notice whenever possible.
If the Administrator removes you from a Space, your access to that map ends, but your Capitown account remains. Data is deleted or anonymized within the time limits in the Privacy Policy, except where the law requires it to be kept.
Changes to these Terms
We may update these Terms to reflect changes in the product or in the law. The date of the latest update is at the top of this page. If a change is significant, we will tell you by email or inside the app, with reasonable notice. If you do not agree with the new version, you can close your account. If any provision is held invalid, the others remain in effect.
Governing law and venue
These Terms are governed by Brazilian law, in particular the Brazilian Civil Rights Framework for the Internet (Law No. 12,965/2014), the LGPD, and, where there is a consumer relationship, the Consumer Protection Code. The courts of the consumer’s domicile are chosen where that applies and, in other cases, the courts of Curitiba/PR, to resolve disputes arising from these Terms.
